These Terms of Service ("Terms") govern your access to and use of trendtik.com and the related dashboard, tools, and APIs (the "Service"), operated by TrendTik ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of the Service

TrendTik provides AI-powered analysis of publicly available TikTok videos and comments, including hook/script breakdowns, transcripts, comment sentiment analysis, and a free TikTok video downloader. Features and quotas vary by plan and may change over time.

2. Accounts & eligibility

• You must be at least 13 years old to use the Service
• You must provide accurate information when creating an account and keep your credentials secure
• You are responsible for all activity that occurs under your account
• We may suspend or terminate accounts that violate these Terms

3. Acceptable use

You agree not to:

• Use the Service to analyze or download content you do not have the right to use
• Violate TikTok's Terms of Service or any applicable law when using content sourced via the Service
• Attempt to abuse, circumvent, or excessively automate feature quotas, rate limits, or credit systems
• Reverse-engineer, scrape, or resell the Service or its underlying AI outputs without permission
• Use the Service to generate or distribute unlawful, infringing, or harmful content

4. Subscription plans, credits & payments

We offer a free tier and paid subscription plans with monthly usage quotas, plus optional credit packs for additional usage. Payments are processed by Dodo Payments, acting as Merchant of Record. Billing terms (price, renewal, and cancellation) are shown at checkout on the pricing page and are governed by these Terms and our Refund Policy.

5. AI-generated content & accuracy

Analyses, transcripts, hook/script breakdowns, and other outputs are generated using third-party AI models (Google Gemini) and are provided "as is". AI output may contain inaccuracies and should not be relied upon as the sole basis for business or creative decisions. You are responsible for reviewing and verifying any output before acting on it.

6. Third-party services

The Service relies on third parties, including TikTok (as a content source), Google Gemini (AI processing), Supabase (data storage/authentication), and Vercel (hosting). We are not responsible for the availability, accuracy, or practices of these third-party services, and your use of TikTok content remains subject to TikTok's own terms.

7. Intellectual property

The Service, including its design, branding, and underlying software, is owned by TrendTik and protected by intellectual property laws. We do not claim ownership of TikTok content you submit for analysis or of the AI-generated reports produced for your account, but we may retain copies as described in our Privacy Policy for service operation and support.

8. Disclaimers & limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, TrendTik and its team will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, data, or business arising from your use of the Service.

9. Termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate your access if you violate these Terms, misuse the Service, or if required by law. Sections that by their nature should survive termination (e.g. intellectual property, disclaimers, liability) will continue to apply.

10. Governing law

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of Ho Chi Minh City, Vietnam, unless otherwise required by applicable law.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
